Owning a condo in Phuket outright
Of everything for sale on Phuket, condos are the only property a foreign buyer can hold freehold, with the title registered in their own name. Two conditions decide whether a particular unit qualifies.
The first is the building’s foreign quota. Foreign owners together can hold no more than 49% of the total floor area of all units, so a popular building can run out of room. Ask the juristic office to confirm the quota position in writing before you commit. Where the quota is full, a unit may only be offered on a lease, so ask exactly how that lease works and whether it will be registered.
The second is how the money arrives. The purchase price has to come into Thailand from overseas, in foreign currency, and the receiving Thai bank issues a Foreign Exchange Transaction form as proof. Without that paper trail, the transfer can’t be registered. For more information check out my detailed step-by-step guide on how to buy a property in Phuket.
Judge the building, then the condo
Two condos with the same view can be very different purchases, because you’re buying into a building as much as a unit. Common area fees are charged per square metre, and the rate varies from one building to the next. You’ll also pay into the sinking fund, the reserve for major repairs. Get both in writing, and ask how healthy the fund is: a building that hasn’t saved enough may come back to owners for a special payment later.
With a branded residence, the hotel group’s management is part of what you’re paying for, so it deserves the same scrutiny. Judging the management behind a branded residence →
If you’re buying to let a condo
Phuket’s condos have been selling well. The question that matters for a buy-to-let is who will rent yours once it’s finished, with 21,671 more units due to complete across the island by the end of 2027 (CBRE). Check any rental forecast against what finished buildings nearby actually achieve today, count how many units will complete around yours, and allow for a handover that slips past the high season. Across the island
The condos for sale in Phuket on this page range from one-bedroom lock-up-and-leave apartments to full-floor penthouses. In Bang Tao you’ll find branded residences; inside Laguna, golf-view and ocean-view units. Layan has sea-view apartments and a penthouse, Surin has residences with their own pools, and Kamala includes an InterContinental residence. Cherng Talay has freehold apartments and a full-floor penthouse with a private pool, and Thalang has one- and two-bedroom apartments.
What are the costs now, and later on
The Land Department charges a 2% transfer fee on the official appraised value. Who pays it is agreed between buyer and seller, so make sure the split is written into the sale agreement. Overall, set aside 2% to 4% above the price, depending on that split and your legal fees. What buying actually costs →
It’s also worth planning how the condo passes on. Your heirs inherit its value, but to keep the unit in their own names they must qualify as foreign owners themselves within a year, or sell it at market price. A Thai will makes that much simpler. Can my children inherit my Thai condo? →
Have a condo in mind?
Send me its name. I’ll look into its quota, its fees and how it’s run, and tell you plainly whether it’s worth a viewing.
